Terms of Service

These terms are a contract between you and the operator of publish.my. Please read them — by using the service, you agree to them.

publish.my (the "Service") is operated by AISOFT TECHNOLOGY SDN. BHD. (Company Registration No. 202401005498 (1551348-X)), a company incorporated in Malaysia ("we", "us", or "our"). These Terms of Service (the "Terms") govern your access to and use of the Service. Our Acceptable Use Policy is part of these Terms.

By accessing or using publish.my — including instructing an AI agent to publish on your behalf — you agree to these Terms and our Acceptable Use Policy. If you do not agree, do not use the Service.

1About the Service

publish.my hosts static websites (files such as HTML, CSS, JavaScript, images, video, audio, and PDFs) at a public address. It is designed to be used by AI coding agents on your behalf: you ask your agent to publish your project, confirm ownership with your email, and your site goes live. The Service does not run server-side code, databases, or backend applications.

2Eligibility

You must be at least 13 years old to use the Service. If you are under 18 (or the age of majority where you live), you may only use the Service with the involvement and consent of a parent or legal guardian who agrees to these Terms. By using the Service you represent that you meet these requirements and that you have the authority to accept these Terms (including on behalf of any organisation you represent).

3Your account & API keys

You do not need to register or set up an account manually. When you first provide your email address to activate a site, we automatically create an account for you linked to that email address.

Your email address is your account identifier and our primary point of contact. We use it to let you sign in to the publish.my console — where you can view and manage your website(s) and API keys — and to send you service messages (such as activation and sign-in links) and important notices, including those relating to security, abuse reports, and our Acceptable Use Policy or these Terms. You are responsible for providing an email address that you control, keeping it current, and for all activity that occurs under your account.

To publish updates, we issue an API key that your agent may store (for example, in a local file) so it can publish without re-verifying your email each time. You are responsible for keeping your API key confidential and for all activity that occurs under it. If you believe your key has been compromised, you can create or revoke keys from the console, or contact us. We are not liable for losses arising from your failure to safeguard your key.

4Your content

You own your content. We do not claim ownership of the websites, files, or other material you publish ("Your Content").

To operate the Service, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, cache, back up, reproduce, transmit, and publicly display and distribute Your Content, and to generate preview thumbnails or screenshots of it, solely as needed to provide, secure, maintain, and improve the Service. This licence ends when you delete Your Content or your site is removed, except for backups or copies that may persist for a limited period as part of routine operations.

You represent and warrant that you own or have all necessary rights to Your Content and that it does not violate these Terms, our Acceptable Use Policy, or any law or third-party right. You are solely responsible for Your Content and for any consequences of publishing it.

5Acceptable use

Your use of the Service must comply with our Acceptable Use Policy, which lists prohibited content and conduct (such as illegal material, malware, phishing, spam, infringement, and abuse of our systems). Violations may result in removal of content or suspension as described below.

6Free service & paid plans

The Service is currently offered free of charge, subject to usage limits we publish (for example, upload size, file count, and monthly view limits). These limits are part of these Terms and may change. Fair-use applies: we may rate-limit, throttle, or decline requests to protect the Service and other users.

Paid plans (such as custom domains and higher limits) are coming soon. When they become available, additional terms — including pricing, billing, renewal, and refund terms — will apply to those plans and will be presented to you before you purchase.

7Availability & changes

The Service is provided on an "as is" and "as available" basis and is under active development. We do not guarantee that it will be uninterrupted, error-free, or available at any particular time. We may add, change, suspend, or discontinue features, limits, or the Service as a whole at any time. We will try to give reasonable notice of material changes where practical, but are not obliged to.

Sites that are deployed but never activated ("staged" sites) are temporary and may be removed automatically after a limited period.

8Suspension & termination

You may stop using the Service and delete your sites at any time. We may, with or without notice, remove content, disable a site or key, or suspend or terminate your access if we reasonably believe you have violated these Terms or the Acceptable Use Policy, if required by law, or to protect the Service, other users, or third parties. For serious violations (such as illegal content or attacks on our systems), we may act immediately. On termination, your right to use the Service ends and your sites and content may be removed.

9Intellectual property

The Service itself — including the publish.my name, logo, website, software, and design — belongs to us or our licensors and is protected by law. These Terms do not grant you any right to use our brand or materials except as necessary to use the Service. Your Content remains yours, as described in Section 4.

10Privacy & data

To provide the Service we process limited personal data, such as the email address you use to activate a site and technical information (for example, IP addresses and request logs) used for security, abuse prevention, and rate-limiting. We use a third-party provider to send transactional emails. We handle personal data in accordance with applicable law, including the Malaysian Personal Data Protection Act 2010. Note that anything you choose to publish is, by design, public.

11Third-party services

The Service relies on third-party infrastructure and providers (for example, content-delivery, hosting, storage, and email providers). We are not responsible for third-party services, and your use of any third-party links or services is at your own risk and subject to their terms.

12Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will meet your requirements, be secure, uninterrupted, or error-free, or that content will be preserved or always available. You are responsible for keeping your own copies of Your Content.

13Limitation of liability

To the maximum extent permitted by law, we (and our directors, employees, and suppliers) will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business, arising out of or relating to your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages. To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service or these Terms will not exceed the greater of (a) the total amounts you paid us for the Service in the three (3) months before the event giving rise to the claim, or (b) fifty Malaysian Ringgit (RM 50).

14Indemnification

You agree to indemnify and hold us harmless from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to Your Content, your use of the Service, or your breach of these Terms or the Acceptable Use Policy.

15Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, for material changes, take reasonable steps to notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.

16Governing law

These Terms are governed by the laws of Malaysia, without regard to conflict-of-law rules. You agree to the non-exclusive jurisdiction of the courts of Malaysia for any dispute arising out of or relating to these Terms or the Service. Nothing in these Terms limits any mandatory consumer rights you may have under applicable law.
